The reality of the situation has been largely misconstrued and exaggerated. The retailer partner for Bourbon Enthusiast did not order the barrel and after 2 months with no order, the distributor had to sell it and found a different retailer to take the product. Because the other retailer placed an official order, the distributor was legally obligated to sell it and shortly after, the original retail partner finally placed the order. In an effort to both be legally compliant and make everyone happy, the barrel was split between the 2 retailers. Keep in mind, this is a heavily regulated industry and there are thousands of nuanced laws that consumers are unaware of and subsequently, not aware of the restrictions and regulations in place. There are serious ramifications for disregarding the ABC laws and can result in the revocation of licenses and hefty fines. The unnecessary drama surrounding this barrel pick stems from a lack of knowledge about the complexities of the three-tier system.
